Certain products are restricted in their use (and therefore the sale of), so various permits or licenses may be required to purchase these products. Whilst many of these products are regulated federally, different requirements and administrative authorities may also apply or vary from state to state. If you are in any doubt please contact the relevant local authority or your preferred distributor.
Bonded Alcohol (Ethanol)
Various grades of Ethanol are restricted and end-users require an Australian Taxation Office (ATO) permit to purchase. These permits are for a specific period of time and a maximum annual usage applies. When purchasing through a distributor, please note that the permit must specify your distributor as the supplier and not ChemSupply Australia. Further information can be obtained from the Excise Business Unit of the ATO.
End User Declarations (EUD)
Chemicals that can be diverted for use in the manufacture of illicit drugs or explosive devices will require an End User Declaration to be completed and approved prior to supply. Refer to your State or Territory police department for further information.
Scheduled Poisons
The Standard for the uniform scheduling of medicines and poisons (SUSMP) classifies products according to their application and/or level of danger. Special regulations restricting their availability, possession, storage and use may apply. Certain poisons can only be supplied to companies that are authorised or licenced to obtain them.
Buyers will generally require a licence or permit to obtain Schedule 4 Poisons (prescription only medicines) and Schedule 8 Poisons (controlled drugs) unless an exemption exists.
Schedule 7 Dangerous Poisons are substances with a high potential for causing harm at low exposure and which require special precautions during manufacture, handling or use. Licences or permits are required to purchase some or all Schedule 7 Poisons, depending on the State or Territory of the purchaser.. Any enquires should be directed to the pharmaceutical services branch of your local State or Territory health authority.
AICIS (Australian Industrial Chemicals Introduction Scheme)
AICIS, part of the Commonwealth Department of Health, is responsible for ensuring the safety of imported industrial chemicals. Some chemicals have not been assessed or approved for use in Australia as the human health and environmental hazards are poorly understood. An exemption exists for the supply of such chemicals that will be used in research or analysis. In order to supply these, we are required to ensure that the goods will only be used for research or analysis. Therefore, customers are required to supply a declaration confirming the end-use of the product.
Biosecurity Requirements for Imported Goods
Certain substances of plant, animal, microbial or fermentation origin may be subject to biosecurity controls (including import permits) depending on the country of origin and end-use. These requirements are controlled by the Commonwealth Department of Agriculture. Biosecurity import conditions are listed in the BICON database: https://bicon.agriculture.gov.au/
Chemical Warfare Agents
The Australian Safeguards & Non-Proliferation Office (ASNO; Department of Foreign Affairs and Trade) monitors the importation and sale of chemicals that could be used in chemical warfare or as precursors for the manufacture of chemical weapons, and permits are required for the importation of these chemicals. The information on the sale of these products must be supplied on request to ASNO who may then contact the end-user to clarify the chemical’s application or use.
WORK HEALTH AND SAFETY
The responsibility of ensuring all applicable work health and safety regulations are observed and other appropriate steps taken in relation to the storage, handling, use and disposal of the goods remains with the buyer. Where information is supplied to the buyer on potential hazards relating to the goods, it is the responsibility of the buyer to bring such information to the attention of its employees, agents, subcontractors, visitors and buyers. Please read the label and/or Safety Data Sheet (SDS) carefully prior to using the product.
